State and PPL move to dismiss DOJ's CDPAP fraud lawsuit, calling it "driven more by politics than by the facts"
NYS Department of Health and Public Partnerships LLC filed a pre-motion letter (Jul 15) seeking dismissal of the DOJ lawsuit alleging the $11B CDPAP home-care contract came from a "sham bid process." PPL argues the DOJ's requested asset freeze under 18 U.S.C. §1345 is foreclosed as a matter of law in a non-criminal case, that fraud claims lack sufficient factual allegations, and that prior lawsuits already upheld the procurement. PPL cites a 2026 statewide survey showing consumer satisfaction of 4.31/5, up from 4.04 in May 2025. First defense filing in the case, which names DOH, Medicaid director Amir Bassiri and PPL.
