EO No. 62 — Temporary moratorium on hyperscale data centers

Nation's first statewide moratorium on new hyperscale data centers, signed July 14, 2026. Pauses DEC discretionary environmental permits for up to one year while DPS develops a Generic Environmental Impact Statement setting statewide standards on energy demand, water use and air quality; press coverage puts the threshold at projects drawing 50+ MW. Also directs ESD to issue a Community Investment Framework within 60 days, directs DPS to consider a Grid Acceleration Fund, and Hochul says she will pursue legislation repealing sales-tax exemptions for large data centers. Comes weeks after the Legislature passed its own one-year data-center moratorium bill, which she has not signed.
