Hochul denounces DOJ notice declaring Olmstead disability-rights guidance "not enforceable"

Hochul denounced a DOJ Federal Register notice (~Jul 20) stating the department will no longer rely on its longstanding Olmstead guidance when enforcing Title II of the ADA, deeming it "not enforceable" — a move advocates say lowers the barrier to institutionalizing people with disabilities. Hochul: "every individual with a disability deserves to live, receive care and support, and thrive in their own community — not isolated in an institution." Follows her June 25 "we understand what is at stake" response to the DOJ's earlier Olmstead memo. Adds another front to the federal-vs-state fights (CDPAP, congestion pricing, Penn Station, election security).
