Federal judge splits ruling on NY immigration laws: mask ban for ICE agents blocked, 287(g) agreement ban upheld

U.S. District Judge Mae D'Agostino (NDNY) ruled Monday evening, Aug. 3, on the DOJ's challenge to the immigration measures Hochul signed in May. She granted a preliminary injunction against the provisions barring federal agents from wearing masks and requiring visible identification, finding they likely interfere with federal law enforcement operations. She denied the injunction against the ban on 287(g) agreements, siding with the state that it is "an appropriate means of furthering New York's legitimate interests." Hochul and AG James said they are reviewing legal options on the mask ban while calling the 287(g) portion a win. The upheld ban directly bears on Nassau's Aug. 25 wind-down deadline.
